MFA, SIFMA, FIA, and AIC submitted an amicus brief to the U.S. District Court of the Eastern District of Pennsylvania in support of ATS Tree Services in its case against the FTC’s Non-Compete Clause Rule.
The brief makes the following arguments:
- The rule would hurt competition and employees in the financial-services industry
- The rule exceeds the FTC’s statutory authority
- The rule does not contain an adequate cost-benefit analysis and otherwise is not supported by the record
